Dhawan had claimed that his wife, who resides in Australia, had put him through mental anguish by making them a long-distance couple and keeping him apart from his son Zoravar for a number of years.

Aesha and Zoravar are both citizens of Australia.

Judge Harish Kumar of the Family Court accepted Dhawan’s charges against his wife and said that Aesha was unable to refute them.

“He (Dhawan) had endured much pain and suffering from living apart from his own kid for years, through no fault of his own. The wife refuted the accusation, saying that she really wanted to live in India with him but decided not to challenge the assertion. According to the court, the respondent’s actions caused him to experience such cruelty, misery, and trauma as to make it impossible for the petitioner to salvage the marriage.

Aesha failed to refute Dhawan’s claims that she coerced him into making her the owner of three homes in Australia. Dhawan also claimed that Aesha ‘compelled’ him to make the purchases.

“The responder had to show that the properties were bought with her money too, or that her name was added out of love and devotion. As a result, the court concluded, Dhawan’s claim that she forced him to declare her the owner of all three properties to some degree or that she stole the revenues from their sales had to be taken seriously.

Dhawan said that in addition to his son Zoravar, he was also required to pay child support for Aesha’s two children from her previous marriage.

He said Aesha was already receiving child support from her former spouse for her two girls.

The court also granted Dhawan visiting privileges so he may see his son.

For visits, overnight stays with Dhawan and his family, and during school breaks, Aesha will have to bring Zoravar to India.
